These General Terms and Conditions expressly regulate the commercial relationship between VitalPeak S.L. (hereinafter, SIMO) and users who purchase products through this website.

VitalPeak S.L., with registered office at C/ Perú 186 bis, 08020 Barcelona (Spain) and VAT number B67964114, reserves the right to modify these Terms of Service at any time. In any case, the terms in force at the time the purchase is made will apply.

These terms have been drafted in accordance with applicable Spanish and European legislation, including but not limited to Law 34/2002 on Information Society Services and Electronic Commerce, Royal Legislative Decree 1/2007 on the Protection of Consumers and Users, and all other relevant consumer protection and e-commerce regulations.

PRODUCT INFORMATION

All information relating to SIMO products, including descriptions, images, videos, ingredients and commercial names, is provided for informational purposes only.

We make every effort to ensure that product information is accurate and up to date. However, minor variations in packaging, presentation or non-essential characteristics may occur due to manufacturing or supply updates, without affecting the quality or functionality of the product.

PRE-PURCHASE INFORMATION

Users may browse all available products on the website, including one-time purchase options and subscription-based products. Each product page includes a description, price, availability and relevant details.

All prices are shown in euros (€) and include applicable VAT. Shipping costs are not included in the product price and will be clearly displayed before completing the purchase.

SIMO reserves the right to correct any obvious typographical errors in prices or product information.

Once an order has been placed, shipping details cannot be modified.

PURCHASE PROCESS

To purchase a product, users must add the desired items to the cart and follow the steps indicated on the website.

Users may complete a purchase either:

• By creating a user account, or

• As a guest, providing the necessary contact and shipping information

Before finalizing the purchase, the user will be able to review the order summary, including products, shipping costs and total price.

If a discount code is available, it must be entered during checkout and will only be applied if valid and compliant with its specific conditions.

The purchase is completed once payment has been successfully processed.

SUBSCRIPTIONS

Some products are offered on a subscription basis. By purchasing a subscription, the user agrees to recurring charges at the frequency and price indicated at checkout.

Subscriptions will automatically renew unless modified or cancelled by the user before the renewal date. Subscription management, including changes or cancellation, can be carried out through the user account or by contacting customer support.

SIMO may notify users in advance of upcoming renewals.

PAYMENT METHODS

Payment may be made by credit or debit card (Visa, MasterCard, American Express or other methods available on the website).

Payments are processed through secure payment gateways using encrypted connections (SSL). SIMO does not store or have access to users’ full payment card details.

In the event of fraudulent or improper charges, users must contact their bank immediately. If a chargeback is initiated without legitimate cause, SIMO reserves the right to claim compensation for damages incurred.

Once payment is completed, the user will receive an order confirmation email.

SHIPPING

SIMO ships products to countries within the European Union.

Shipping costs depend on the destination, weight and shipping method, and will be displayed before completing the purchase.

Users are responsible for providing accurate and complete delivery information. SIMO is not responsible for delays or failed deliveries caused by incorrect or incomplete addresses.

Once the order has been shipped, tracking information will be provided where available.

DELIVERY CONDITIONS

The user is responsible for checking the condition of the package upon delivery.

If the package or product appears damaged or incorrect, the user must:

• Note the issue on the carrier’s delivery receipt, if applicable

• Contact SIMO at hello@simo.health within 24 hours of delivery

Failure to do so may affect the ability to submit a claim.

All applicable taxes are included in the product price. Any additional charges derived from customs or import procedures (if applicable) will be borne by the buyer.
